Terms of Use
Your use of Pipwing is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"). The terms below add a few things specific to Pipwing. If they conflict with the Standard EULA, the Standard EULA wins.
In plain English: Pipwing's answers are AI estimates from a photo, so never rely on it for anything safety-critical. Enjoy birds from a distance, and leave feathers, nests and eggs where you find them.
1. Who these terms are with
Pipwing is provided by Little Finders Club ("we", "us"). By downloading or using Pipwing you agree to the Standard EULA and these supplementary terms. Apple is not responsible for Pipwing or its content, except as set out in the Standard EULA.
2. Subscriptions
- Pipwing is free to download. You can identify 3 birds free; after that, identifying birds requires an auto-renewing subscription, sold through Apple's App Store: yearly ($19.99 per year in the US, with a 7-day free trial for eligible new subscribers) or monthly ($3.99 per month in the US, no free trial). Both can be shared with your family through Apple Family Sharing. Prices in other countries are shown in the app before you buy.
- Payment is charged to your Apple Account when you confirm the purchase. With the free trial, your first payment is charged when the trial ends unless you cancel at least 24 hours before it ends.
- Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period. You can manage or cancel anytime in Settings › [your name] › Subscriptions on your iPhone.
- If you allow notifications, we'll remind you two days before your free trial ends.
- Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. We can't issue refunds directly because we never receive your payment details.
- Fair use: to keep the service fast and affordable for everyone, subscriptions include up to 40 scans a day. We may adjust these limits with notice in the app, and won't lower them below what a typical birder needs.
3. AI identifications are estimates
Pipwing identifies birds using artificial intelligence provided by third parties (see our Privacy Policy). A photo can't always separate look-alikes: for example a downy from a hairy woodpecker, a Cooper's from a sharp-shinned hawk, female ducks, or young sparrows. Distance, blur, lighting, angle, molt, age, sex and season all change how a bird looks. Results, including names, confidence levels, facts, "Sounds like", "Around now?", how common a bird is where you live, "Could also be" suggestions, "Check it" tips and "Did you know?" facts, are informed estimates, not certainties, and can be wrong. For anything that matters, check with a field guide, a local bird club, a nature centre or an experienced birder. Never rely on Pipwing for anything safety-critical, such as whether a bird or other animal is safe to approach or handle, or whether a bird is sick.
4. Be kind to birds and stay safe
Pipwing is for watching and learning. The best birding leaves birds exactly as they were.
- Watch from a distance. Use your camera's zoom or binoculars. If a bird changes what it's doing because of you, you're too close.
- Never touch, chase, feed by hand, or disturb wild birds, their nests, eggs or chicks. Parents may abandon a nest that's been disturbed.
- Don't play recorded calls to attract birds. It can stress them and pull them away from feeding or nesting. Pipwing never suggests it.
- Don't feed bread to ducks, geese or other waterbirds. It's bad for them and for the water they live in.
- Found a hurt or orphaned bird? Don't try to care for it yourself: contact a local licensed wildlife rehabilitator for advice. Most fledglings on the ground are fine; they're learning to fly, and their parents are usually nearby.
- Kids should bird with a grown-up, and always have adult supervision near water, cliffs or roads.
- Don't trespass. Stay on paths, respect private property, and follow park rules and signs, including seasonal closures that protect nesting birds.
5. Feathers, nests and eggs: the law
In the United States, the Migratory Bird Treaty Act makes it illegal to collect or possess the feathers, nests or eggs of most native wild birds without a permit, even ones you find on the ground. Eagle feathers are separately protected under the Bald and Golden Eagle Protection Act. Similar laws protect wild birds, their nests and eggs in the UK (the Wildlife and Countryside Act 1981), across the European Union, and in many other countries.
Pipwing never encourages collecting feathers, nests or eggs. If you find one, photograph it where it is and leave it there. Pipwing doesn't tell you what is legal where you are, and this section is general information, not legal advice.
6. "Find it again" tips are general suggestions
Results include a "Find it again" tip: for backyard and feeder families, things like which food a bird likes, clean water, native plants, nest boxes or window safety; for everyone else, where and when to look for that bird nearby. These are general suggestions, not instructions for your situation. Keep feeders and bird baths clean, follow local guidance (for example, during bird-flu outbreaks some authorities ask people to take feeders down for a while), and never feed wildlife in places where it's banned.
7. Where you go birding
You're responsible for where you go and what you do there. Get permission before entering private land, follow local laws and signs, and stay safe around water, cliffs, roads and in bad weather. Pipwing doesn't tell you whether you're allowed to be somewhere.
8. Your photos and notes
Your photos and notes stay yours. You give us permission to send the photos you choose to scan to our server and AI providers, only to produce your result, as described in the Privacy Policy. Only scan photos you have the right to use, and don't use Pipwing to upload anything illegal or that isn't a photo of a bird, feather, egg, nest or similar subject.
9. Acceptable use
Don't misuse Pipwing or its server: don't try to get around scan limits or the subscription, reverse-engineer or overload the service, or use it to build a competing dataset or service. We may limit or block access for misuse.
10. Availability and changes
Identification needs an internet connection and depends on our server and AI providers. We work to keep it running but can't promise it will always be available or error-free. We may improve, change or discontinue features. If we discontinue the service, we'll give notice in the app where we reasonably can.
11. Disclaimers and limitation of liability
To the fullest extent permitted by law, Pipwing and its content are provided "as is" and "as available", without warranties of any kind, as also set out in the Standard EULA. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from relying on an identification, tip, activity or "Check it" suggestion. Our total liability for any claim relating to Pipwing is limited to the amount you paid for Pipwing in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, or your statutory rights as a consumer.
12. Governing law
These supplementary terms are governed by the laws of [GOVERNING LAW JURISDICTION], except where the law of your country of residence gives you mandatory consumer protections, which still apply.
13. Changes to these terms
We may update these terms. We'll change the effective date above and, for significant changes, let you know in the app. If you keep using Pipwing after a change, the updated terms apply.
